ADA COMPLAINT PROCEDURE
Complaint Procedure
This Grievance Procedure is established to meet the requirements of the Americans with Disabilities Act (ADA) of 1990.
Who May File
Any individual who has attempted to access one of the City's services, activities, or programs, and who believes that he or she has been discriminated against based on a disability.
The Complaint
The complaint may be in writing or you may request an in person interview with the ADA Compliance Officer. The Compliance Officer may assign the matter to his/her designee for investigation.
The complainant should have information readily available for the investigator. Information should include contact information, and all relevant facts of what occurred. All relevant facts include but are not limited to location, date, time, any interaction with City employees, names and other information, as deem appropriate.
The complaint should be made as soon as possible, but no later than 30 calendar days from the date of the alleged violation to the Compliance Officer.

An intake interview will be scheduled, and an investigation of the allegations will be conducted. Following the investigation, a report and recommendation will be provided to the Compliance Officer. A determination will be prepared, in writing, and mailed certified to complainant, and a copy provided to the City Attorney’s Office.
Appealing the Decision from the Compliance Officer
If complainant wishes to appeal the Compliance Officer’s decision, they may do so, in writing, to the City Manager within 30 days from receipt of the decision.
All investigative files will be kept archived for three years with the Fayetteville-Cumberland Human Relations Department.
